In the education sector, there is the expectation that all institutions—whether in higher education, further education or multi-academy trusts—will have an independent review of their governance every three to five years.

Higher Education

The CUC Higher Education Code of Governance (and the Scottish Code of Good HE Governance) recommends that institutions must conduct an independent review of their governance effectiveness at least every four years.

In the current operating climate, all higher education institutions (HEIs) must be particularly alert to the need to review their governance structures, systems, and processes to ensure that they are responsive and fit-for-purpose.

Further Education

Under the Skills and Post-16 Education Act 2022, there is a mandatory requirement for colleges to commission an external review of governance every three years. Such a review isn’t just about checking for compliance with the Code of Governance, it’s about looking at the effectiveness of governance and making sure that the chair, governors and senior leadership team are all supporting good governance.

Multi-Academy Trusts

The Department for Education recommends an external review of governance before there is any significant change, including conversion to academy status or before a MAT grows significantly. In our view, a governance review is valuable every few years, to confirm your areas of strength and identify areas for development.
